The website Timemint.co and the application TimeMint are created, produced, and operated by the company Nextspire Limited, hereafter referred to as the "Company" or "We", throughout this service agreement. We are committed to protecting the privacy of both the organization's and employees' data in accordance with the data transmission procedures set by the users in our system. The user-defined permissions are considered consent to disclose data according to the purpose of the settings in our system. Whether transmitting images, information, sound, location, via email, or via LINE, the company will not be responsible for the results of forwarding data that you have set to send to email or LINE to other individuals as specified by the user, even if it is a wrong setting in our system.


Furthermore, to maintain the data integrity of our users' organizations and their employees, and any data generated from our website or our application, we will not directly modify any user data to ensure the credibility of all our service users' organizational data.


Database Level Data Change Request: If any organization or entity using our system to record and transmit data needs changes at the database level, we will not process it in every case unless there's an official letter issued and certified by the authorized person. Even with such a letter, the company reserves the right to adjust data at the database level at our discretion. There may be requests to inspect documents or other evidence to consider changing any part of the data accessed directly from the database. If there is a dispute between the company and its employees regarding the use of data, whether time logging or otherwise, the company can notify in writing to inspect the database level with us. The purpose is to verify any software programming errors and record accuracy. If any errors arise from coding instructions and calculations from the program or command set, we will adjust the data according to the evidence the company can provide.


Any electronic images or electronic data that users upload into our service system must be images that do not violate good morals or good governance in business dealings between employees and legal entities. Moreover, electronic media images uploaded into the system must not violate any laws in the Kingdom of Thailand. Any photos or electronic media that are deemed illegal or potentially violate the Computer-related Crime Act, such as any indecent images, will be immediately removed, moved, or destroyed by our website and application administrators without prior notice. This is to ensure the general and appropriate use of the application in line with its intended purpose. The company reserves the right to notify inappropriate behaviors related to images directly to you or your organization to prevent future problems concerning both business ethics and laws enforced in the Kingdom of Thailand.


Information collected for marketing purposes: Our website and application use cookies to collect data about how the site or app is used and to track user behavior. This information is used to analyze and improve the user experience and for marketing analytics of the website, including sharing data with third-party providers that track such behaviors. However, personal data is not shared with these providers. This follows standard cookie practices. However, you can opt to prevent the website from setting cookies without affecting any functionality if you do not consent to tracking your website behavior.


Users agree that the company can use some or all of the data to develop or review our services. The company will notify the main users, as recorded in our system, directly about which data will be used for development or service testing and for what purposes. Announcements will be made through channels such as email notifications.


Any data generated from your account that hasn't been used continuously for more than 2 months will have its access rights removed from all our websites and applications. We reserve the right to delete, destroy, or alternatively, back up data in other formats that you may no longer be able to access through our service. If you wish to maintain any data associated with your user account, you can contact us directly to adjust the data retention period on a case-by-case basis.


Using our service system must be in accordance with the purposes for which we have designed it. If we become aware that any user behaves in a manner inconsistent with the intent of regular use, especially when sending data through our system, whether via website or application, we reserve the right to suspend such services, even if payment has been made. The service provider reserves the right to terminate the service without refunding any fees if users act contrary to our service policies. The service provider will determine if the user's actions violate any of our rules or regulations.


The service provider is not responsible for any damage to the accuracy or loss of data for any reason, such as errors caused by the user's own equipment, accidental deletion of user data or accounts, or any unforeseen circumstances arising from either the service provider or the user.


Any content, articles, or announcements made through the service provider's system should not have the following intentions or content: sending chain messages to generate numerous responses, sending repetitive messages to others, content that violates personal rights and welfare, threatens others, etc. Content or links related to hacking, virus dissemination, illegal activities, morality violations, causing chaos and troubles for others, interfering with server operations, excessive use of server resources, infringing trademarks, copyrights, intellectual property of others globally, threatening, cheating, spreading false information, vulgar language, drugs, content or links that can harm the service provider or company. Any content or links that violate the "Computer Crime Act B.E. 2550 (2007)" and any content or links that the service provider deems inappropriate. If any content meets the above criteria, we reserve the right to delete and suspend the dissemination of any or all content through our system without notifying the user.


While we make significant efforts to ensure our users can access our service whenever they want, we cannot guarantee 100% uptime due to various unforeseen reasons and risks. These could be due to issues within our system's commands, changes in the commands made during system enhancements or corrections, or due to access issues related to servers that are serviced by companies under the care of hosting and database providers at the DATA CENTER at CSloxinfo Internet Data Center on the 16th floor of the CAT Telecommunications Building, Bang Rak, which is managed by the expert team of CS Loxinfo Public Company Limited. Therefore, our company reserves the right to disclaim liability for any risks mentioned in these terms of service. Moreover, the service provider reserves the right to change these terms of service at any time without prior notification to the users.


Policy on Equipment Insurance and Service Refunds Regarding.


Product Warranty
Any equipment sold for use with the service is divided into two main types: those sold separately to customers or buyers, specifying a definite warranty period, and those sold as bundled products with specified service warranty period. Each type has different conditions as described in the following documents.


In the case of equipment sold separately.
Hardware devices used for the TimeMint system, sold to customers, have different product warranty structures for each model, as indicated in the product quotation documents, specifying the warranty period in days or months from the date you received the goods. The starting date of the product and hardware warranty is determined based on the delivery date of the goods, using the evidence provided by the shipping company. However, if you fail to keep the evidence of the tracking number or the receipt of product acceptance, the starting date of the product and hardware warranty will be considered as the date when the customer made the payment for the goods. In any case, if you make a purchase without a specific quotation, the warranty period for such equipment is considered to be 6 months unless specified otherwise in the quotation document.


In the case of equipment purchased with a service contract providing warranty throughout a specific period
For equipment that is not sold separately, it is considered as a warranty or we may use the term "service warranty for the entire duration." These equipment are considered as part of our service to provide information and for customers to use under the conditions of service. The product warranty period according to this service duration is equal to the duration of the account in the TimeMint system that has not been terminated based on the terms and conditions of the account usage on the TimeMint system. Equipment covered under the service warranty period will be reserved or replaced for the service users and sent to customers within a reasonable period. However, we reserve the right to find replacement equipment that may not be of the same model or may have changes in type, depending on whether the product is still produced or sold in the market.


Product Warranty Terms
Equipment under the warranty period must be used under the normal conditions intended for that type of product and must not be used improperly or for unintended purposes. Additionally, the equipment should not experience falls, impacts, or exposure to water. If the equipment is damaged due to abnormal conditions more severe than general usage, customers will not be able to claim the warranty. In such cases, customers might need to purchase a new product as a replacement for the original equipment. However, for devices with a time-based warranty, if the equipment is used improperly or damaged due to abnormal conditions like falls or water exposure, the customer might need to purchase the same model or a different one to replace the damaged equipment so that we can continue to provide services according to the agreed period based on the TimeMint service system.


Request for Hardware Refund
If you have already paid for the equipment, regardless of the method, both in terms of purchase and service, these equipment fees cannot be refunded under any circumstances. However, if you find that the equipment has operational problems or think it was damaged upon delivery, you can contact us through all available channels. The terms can be considered for replacement or repair of the equipment within the time frame specified under the product warranty terms for each item.
